GUIDELINES FOR GETTING MARRIED IN LEON COUNTY

  • Both applicants MUST be present to apply for the license. After September 1, 2013, the only exception is for active military personnel. If one applicant is unable to apply due to incarceration, see the instructions and affidavit links below in the "FORMS" category.
  • Per Family Code 2.003(a) As of Sept. 1, 2017, applicants under the age of 18 may not marry unless the person has been granted by Texas or another state a court order removing the disabilities of minority of the person for general purposes.
  • Both applicants must supply the required ID in accordance with Section 2.005 b of the Texas Family Code.
  • Both applicants will need to supply their social security number; written proof is preferred but not required.
  • The fee is $71, unless both applicants cannot prove Texas residency, then a $100 fee is added per Local Government Code 118.018(d).
  • There is a 72-hour waiting period from when we issue the license to when you may be married.
  • If applicants have completed the twogetherintexas program, the fee is reduced to $11, and the 72-hour waiting requirement is waived. For more information, go to www.twogetherintexas.com
  • If either applicant has been previously divorced, he or she must have been divorced for MORE than 30 days (unless you are remarrying the same person you divorced AND have not married someone else in between, then bring a certified copy of the divorce decree with you when applying).
  • License is good for 90 days after the date of issuance.
  • The ID that is presented will be used to provide information for the license.  That means the name will appear on the license exactly as it appears on the ID provided. No exceptions.
  • Due to the time required to issue a license, please arrive at the clerk’s office prior to 4:30 p.m.
